#1 KAVANAUGH LIED TO CONGRESS<\/span><\/h2>\n

  1. He <\/span>testified<\/span><\/a> that he first learned of Deborah Ramirez\u2019s allegations after The New Yorker story was published. Friends <\/strong><\/span>dispute that claim<\/a>.<\/strong><\/li>\n
  2. He <\/span>testified<\/span><\/a> that he \u201cnever attended a gathering like the one Dr. Ford describes.\u201d\u00a0His own <\/strong><\/span>calendar entry<\/a> from July 1, 1982 shows that he did.<\/strong><\/li>\n
  3. He <\/span>testified<\/span><\/a> that <\/span>Leland Keyser<\/span><\/a>, <\/span>Patrick Smyth<\/span><\/a>, and <\/span>Mark Judge<\/span><\/a> all \u201crefute\u201d Dr. Ford\u2019s allegations. Their sworn statements do not refute her allegations<\/a>.<\/strong><\/span><\/span><\/li>\n
  4. He <\/span>testified<\/span><\/a> that he never drank so excessively that he lost memory or became aggressive. His own <\/strong><\/span>notes<\/a>, yearbook entry<\/a>, and speeches<\/a>, as well as memoirs<\/a>, friends<\/a>, classmates<\/a>, roomates<\/a>, and a police report<\/a> dispute those claims.<\/strong><\/li>\n
  5. He <\/span>testified<\/span><\/a> that the meaning of <\/span>\u201cDevil\u2019s Triangle\u201d<\/span><\/a> \u201cboof\u201d<\/span><\/a> and the <\/span>seven F\u2019s<\/span><\/a> listed in his yearbook entry referred to a drinking game, flatulence, and a \u201cwind-up\u201d to a curse word. They do not<\/a>.<\/strong><\/span><\/span><\/li>\n
  6. He <\/span>testified<\/span><\/a> that he got into Yale without having connections. He was a <\/strong><\/span>legacy student<\/a>.<\/strong><\/li>\n
  7. His <\/span>written answers<\/span><\/a> to congressional questions claim he had no knowledge of inappropriate behavior by disgraced judge Alex Kozinki. One of Kozinki\u2019s former clerks says the claim is <\/strong><\/span>not believable<\/a>.<\/strong><\/li>\n
  8. He <\/span>testified<\/span><\/a> in 2006 that he learned about Bush\u2019s \u201cWarrantless Wiretapping Program\u201d from a NY Times story in 2005. <\/span>Email<\/a> shows that he discussed it internally while working at the White House in 2001.<\/strong><\/li>\n
  9. He <\/span>testified<\/span><\/a> in 2004 that he had no involvement in the nomination efforts of the controversial anti-Roe v. Wade judge William Pryor. <\/span>Emails<\/a> show that he did.<\/strong><\/li>\n
  10. He <\/span>testified<\/span><\/a> in 2004 that he had never seen any judicial strategy documents that were stolen from staffers of Democrats on the Judiciary Committee. Emails (<\/strong><\/span>here<\/a>, here<\/a>, and here<\/a>) show that he did.<\/strong><\/li>\n<\/ol>\n

    <\/h2>\n

    #2 KAVANAUGH IS CREDIBLY ACCUSED OF SEXUAL ASSAULT<\/h2>\n

    The FBI has expanded its background investigation to include three accusations of sexual assault and misconduct. <\/span><\/p>\n

      \n
    1. Christine Blasey Ford claims that Kavanaugh sexually assaulted her in 1982 when she was 15 and he was 17. She has already submitted to <\/span>polygraph<\/span><\/a>, <\/span>testified before Judiciary Committee<\/span><\/a>, provided <\/span>supporting statements<\/span><\/a>, and is willing to be interviewed by FBI.<\/span><\/li>\n
    2. Deborah Ramirez <\/span>claims<\/span><\/a> that Kavanaugh sexually assaulted her during a party at Yale during the 1983-84 school year. She has recently been interviewed by the FBI. <\/span><\/li>\n
    3. Julie Swetnick <\/span>claims<\/span><\/a> that Kavanaugh was abusive and sexually aggressive towards girls in high school, and that he participated in adding drugs or alcohol to drinks for the purpose of making girls too inebriated to refuse sexual consent. She is willing to be interviewed by FBI.<\/span><\/li>\n<\/ol>\n


      \n#3 KAVANAUGH LACKS JUDICIAL TEMPERAMENT<\/span><\/h2>\n

      Judge Kavanaugh\u2019s recent <\/span>testimony<\/span><\/a> regarding allegations of sexual assault highlighted a temperament unfit for service on our nation\u2019s highest court. His <\/span>prepared remarks<\/span><\/a> were delivered with vitriol, spite, and open hostility, and he at times responded to serious and important questions from senators with belligerence and contempt. On numerous occasions, Judge Kavanaugh took a strikingly partisan posture, offering conspiracy theories about 2016 election anger and the Clintons that were entirely unbecoming of a judge on any court. More than 500 law professors from nearly 100 law schools <\/span>signed a letter<\/span><\/a> to the U.S. Senate to say that the volatile temperament Judge Brett Kavanaugh displayed in those hearings disqualifies him from sitting on the nation\u2019s highest court.<\/span><\/p>\n


      \n#4 KAVANAUGH IS HOSTILE TO <\/span>ROE v. WADE<\/span><\/i><\/h2>\n

      While Judge Kavanaugh stated in private interviews and testimony that he considers <\/span>Roe v. Wade<\/span><\/i> to be settled law, other statements and dissents contract this and show a willingness to chip away at reproductive rights and abortion access until <\/span>Roe v. Wade<\/span><\/i> is rendered meaningless. <\/span><\/p>\n

        \n
      1. In a September 18, 2017 <\/span>speech<\/span><\/a> to the American Enterprise Institute, Kavanaugh stated that he agrees with Justice William Rehnquist\u2019s dissenting opinion on Roe v. Wade. <\/span><\/li>\n
      2. In the 2017 <\/span>Garza v. Hargan<\/span><\/i><\/a> case, Kavanaugh\u2019s dissenting opinion favored unreasonable restrictions to a woman\u2019s access to abortion. <\/span><\/li>\n
      3. In the 2015 <\/span>Priests for Life v. HHS<\/span><\/i><\/a>, Kavanaugh\u2019s dissenting opinion favored the religious views of corporations over the reproductive rights of individuals.<\/span><\/li>\n<\/ol>\n


        \n#5 KAVANAUGH IS HOSTILE TO INDIGENOUS RIGHTS<\/span><\/h2>\n

        Kavanaugh has <\/span>written<\/span><\/a> and <\/span>argued<\/span><\/a> that only Native peoples who are organized into tribes living on reservations are entitled to special recognition under the law. But not all indigenous peoples are organized the same way. Alaska Natives are organized as tribes, villages and regional corporations. Kavanaugh also argued against the constitutionality of programs for Native Hawaiians, saying, \u201cany racial group with creative reasoning can qualify as an Indian tribe.\u201d His view could upend decades of progress for all Native communities.<\/span><\/p>\n


        \n#6 KAVANAUGH WON\u2019T CHECK ABUSES OF POWER<\/span><\/h2>\n

        Kavanaugh <\/span>wrote<\/span><\/a> recommendations for changing laws to establish that sitting presidents cannot be indicted, stated that no attorney general or special counsel has the credibility required to rise above accusations of political motivation, and stated that a remedy to presidents attacking independent counsels they deem politically motivated is to give presidents the authority to dismiss them.<\/span> He also <\/span>wrote<\/span><\/a> that the president\u2019s powers to pardon or to choose to not investigate or prosecute a crime are absolute.<\/span><\/p>\n


        \n#7 WE DON\u2019T HAVE A COMPLETE RECORD<\/span><\/h2>\n

        The National Archives<\/span><\/a> is responsible for reviewing and releasing permanent records relating to Kavanaugh\u2019s time working in George W. Bush administration and for the Ken Starr investigation during the Clinton administration, but it has not yet completed its work. Only 10% of the documents have been seen by the Judiciary Committee. \u00a0Senators cannot make an informed decision on nominees without full access to their record.<\/span><\/p>\n
